These TERMS AND CONDITIONS govern the relationship between Furnite Ltd (www.furnite.bg) and the Users of electronic (Internet) pages and services located at the domain www.furnite.bg and its subdomains (the Site(s)) and using the information and commercial services offered by www.furnite.bg (the Service(s)) on the Site. In order to be able to use the Services of www.furnite.bg, the User shall register on the Site, by which the User agrees, fully accepts and undertakes to comply with these Terms and Conditions.

1. Terms of use of the Site www.furnite.bg
By registering on the Site, the User confirms and declares his/her consent to the following:

- The information services on the Site are provided "as published".

- www.furnite.bg is not responsible for the accuracy of the information published.

- www.furnite.bg is not responsible or liable for the timing of delivery of information regarding User's completed orders, the status of User's or other Users' inquiries, questions and comments about products, product availability, and for damages and/or lost profits and other losses of any kind or amount occurring after, as a result of, or due to use/inability to use (due to technical problems, maintenance, administrator decisions, etc.) the Site.

- www.furnite.bg shall not be liable in the event that the User incurs any damages while using the Site or materials therefrom that require repair or correction of equipment or loss of information, and all costs associated with remedying such damages shall be borne by the User.

- The on-line purchasing system through the Site reflects the availability of the items at the time of the current check, however, given the dynamics in the inventory turnover, it is possible that certain items and their accessories, posted and listed on the Site as "available" in the Furnite store at the time of the check, may be out of stock at the time of the request and cannot be ordered and delivered through the on-line store. In any case, www.furnite.bg confirms the possibility / impossibility of delivery of the goods ordered via the on-line system.

- It is possible that the parameters (delivery time/delivery method, etc.) of an order placed through the Op-line system may be changed, and www.furnite.bg is obliged to notify the User of the changes made to the e-mail and / or contact telephone number provided by the User and / or in any other appropriate manner, at the latest by the time of sending the User the message for delivery of the confirmed order to the address of the User.

- In order to use the services of the Site, the User shall access the World Wide Web directly or through other devices that access Web-based content by securing all equipment necessary to access the World Wide Web, including a computer, modem or other means of accessing the Internet network. www.furnite.bg is not responsible for any interference or technical problems that prevent use of the Site due to the quality of the computer equipment operated by the User.

- When registering on the Site, the User shall provide true, accurate, current and complete information necessary to complete the sale by completing all required fields on the registration form.

- www.furnite.bg shall not be liable for any incorrect and/or inaccurate order in the event that the User provides false, inaccurate, not current or incomplete information, and shall further have the right to deny the person further access to some or all of the services offered on the Site.

- To receive information through the contact methods provided about products and services on www.furnite.bg, in the event that the User does not wish to receive such information. User should expressly decline to receive the same through the inquiry and contact forms provided on the Site.

2. Privacy Policy.

- The recipients or categories of recipients to whom the personal data may be disclosed are the natural persons to whom the data relate or other persons if this is provided for in a legal act. Personal data provided by the User shall not be disclosed to third parties for advertising and promotional purposes.

- Ovens Ltd. processes Personal Data only on condition that the individual to whom the data relate has given his/her explicit consent, in the absence of explicit consent from the individual to whom the data relate, Ovens Ltd. is not entitled to process his/her data. By providing his personal data, the User automatically gives his express consent to its processing.

- Each individual has the right to access, by written application, personal data relating to him or her, as well as the right at any time to request that Ovens Ltd erase, correct or block his or her personal data, the processing of which does not comply with the requirements of the DPA.

3. Copyright and related restrictions.

Users may use all services offered on the Site for personal, non-profit purposes and provided that they do not infringe the copyrights of bbqshop.bg or third parties related directly or indirectly to the materials on the Site. It is expressly forbidden to copy, publicly distribute or give away the materials published on this Site for any purpose by the Users.

www.furnite.bg reserves the right to assign the rights to publish materials and other information published on the Site to third parties, subject to a further written agreement between www.furnite.bg and the person publishing the information.

When purchasing goods subject to copyright and/or patent rights, www.furnite.bgне grants no additional rights of use and distribution, except the rights and/or licenses expressly mentioned by the manufacturer/distributor of the goods.

All goods and services provided by www.furnite.bg which are protected under the Copyright and Related Rights Protection Act , are provided to Users in their original form, packaging and medium without any influence from www.furnite.bg and in accordance with the licenses and distribution rights granted by their manufacturers and/or distributors for the Republic of Bulgaria.

Links on the Site to other sites owned by third parties are posted for the convenience of Users. When using such a link, users are not using a service provided by bbqshop.bg and with respect to the use of the link outside the Site, these Terms and Conditions do not apply.

www.furnite.bg is not responsible for the information and/or content of other sites owned by third parties and does not impose or recommend the use of these sites or the information published on them. Any risks associated with the use of such sites are borne by the Users.

4. Goods and services presented on the Site.

The information about the goods on the Site is divided into types of groups and subgroups;

The page (link) to each item listed on the Site provides information on the price, the main characteristics of the goods and additional information aimed at helping Users make an informed choice when purchasing the product. www.furnite.bg is not responsible for any inaccuracies in the description of the goods that do not relate to the main and characteristics of the goods and does not claim the completeness of the information provided.

www.furnite.bg reserves the right to publish names, models and other information about goods in English or any other language where:

(a) There is a danger that valuable information concerning the characteristics of the goods may be lost by translation;

b) There is no generally accepted unambiguous terminology in the English language;

c) The good itself is a medium of information in English or another language, for example, software, music and movies in English or another language;

All prices quoted on the website are in Bulgarian Leva and include VAT. In case the goods have several modifications, the prices for each modification are indicated on the page. www.furnite.bg has the right to make changes to the published products, services, prices and other characteristics of the goods at any time and without notice, and Users shall be deemed informed of said changes from the date of their publication. The information for some of the published products may not be updated, but in any case Users will be notified in the case of an order placed on the Site with an on-line purchase form prior to their delivery of the non-updated information on the Site related to the ordered products. Some of the information posted on the Site may relate to products, services or programs that are not currently available or offered.

5. Purchase goods and/or services from the Site www.furnite.bg

The User is entitled to order all goods and services listed on the Site at www.furnite.bg. When placing an order, the User has the right to choose the type, make and model of the goods and their quantity, payment terms, method and delivery terms, according to the options offered on the Site.

At any time before the final confirmation of the order by filling in the on-line purchase form, the User has the right to make changes to the goods and services selected.

When placing an order on the Site, the User enters into a contractual relationship with "Furnite Ltd" for the purchase of the selected item, regulated by these General Terms and Conditions, and the order placed is considered confirmed upon receipt of confirmation from www.furnite.bg, containing all the above parameters and in accordance with the instructions set out on the Site;

www.furnite.bg has the right to change the prices indicated on the Site at its sole discretion, at any time and without being obliged to notify Users in advance. The User is obliged to pay the price that was indicated on the Site at the time the order was placed, whether lower or higher than the updated price. In the event of technical errors in the information published on the Site, resulting in the order not being fulfilled, www.furnite.bg shall have the right to refuse the execution of the order and shall not owe any compensation to the User other than a refund of the amounts paid and/or deposited by the User for the cancelled order, if any.

6. Payment for goods and services purchased

In case of payment in cash on delivery of the ordered and delivered goods and services, the User is obliged to pay at the time of delivery to www.furnite.bg or its representative/subcontractor carrying out the delivery of the ordered goods its full value according to the confirmed order.

In case of payment by bank transfer, the User shall pay an amount equal to the value of the goods delivered according to the confirmed order to the bank account of "Furnite Ltd" Ltd indicated in the generated invoice and only after the payment is confirmed as received and the bank account is credited with the corresponding amount, www.furnite.bg shall execute the delivery of the ordered goods and services.

Online payment is made by credit or debit card under secure conditions.

7. Delivery of purchased goods

The delivery time for the goods ordered and for which payment has been received, to the address indicated by the user, is from 24 hours to 4 working days after receipt of order confirmation, the time may be extended on public holidays and/or weekends by the period of non-working days. In all cases, there may be a delay in the delivery times indicated, which shall be promptly notified to the user by www.furnite.bg.

The delivery of the ordered goods shall be carried out in the manner chosen by the User and according to the terms indicated. www.furnite.bg reserves the right to extend the terms indicated by up to 7 (seven) days without informing the Users in advance, and to extend the terms by more than 7 (seven) days with the prior consent of the User requesting the delivery.

When ordering a purchase from the online store, in the "Remarks", the User has the option to specify a convenient day for delivery, and www.furnite.bg shall tailor the delivery to the User's preferences, of which the User shall be promptly notified.

www.furnite.bg may request further confirmation from the user of the order, including by telephone, fax, e-mail. In the event that the User refuses to provide the information requested by www.furnite.bg, the refusal to provide such information shall result in the automatic cancellation of the order with or without further notice to the User.

"Furnite Ltd shall have no obligation to assemble and install the delivered goods. Delivery of goods purchased from "Furnite Ltd" Ltd. is made to:

1. The door of an apartment or office for buildings commissioned with a model 16 certificate, with a working lift allowing the appliances to be boarded.

2. A door to a yard, in the case of houses with a yard, or to a door to a house in the case of houses without a yard, to which there is a passable vehicular way;

3. The entrance of a residential building when the same is not commissioned with a certificate of Form 16 and/or there is no working elevator, and in any other case not covered by the above conditions.

www.furnite.bg shall not be liable for delay in delivery due to circumstances beyond www.furnite.bg's control, such as delay on the part of the courier making the delivery.

Upon delivery, the goods should be carefully inspected by the User and/or his authorized person. In the event of any external visible defects - possible damage, knocks and other damages found upon delivery, the User should sign a damage report in the presence of the courier, describing the defects found and immediately notify www.furnite.bg at tel. 359 (0) 888 817 472

Upon acceptance of delivery by the User without remarks, any and all subsequent claims for any visible defects of the goods received shall be deemed to be unfounded and as such shall not be satisfied. In the event that a damage report is not drawn up and signed in the presence of the courier upon receipt of the goods and/or does not immediately notify www.furnite.bg at 359 (0) 888 817 472 , the Consumer shall forfeit his right to have the identified external visible defects brought into conformity with the contract of sale.

In the event of an incorrect or wrong address, contact person and/or telephone number being provided when placing the order,www.furnite.bg shall not be liable for inaccurate execution of the order as a result of incorrect information provided by the User.

Upon delivery of the goods, the User or a third party designated by the User shall sign the accompanying documents. The third party is considered to be any person who is not the holder of the application but accepts the goods upon delivery to the delivery address indicated by the User.

In the event that the User is not found within the delivery period at the address indicated by him/her and/or access to the delivery address is not provided, www.furnite.bg shall be released from its obligation to deliver the goods ordered and the User shall lose the possibility of having the goods ordered by him/her delivered.

Where the goods delivered are clearly not in conformity with the goods requested for purchase by the User and this can be ascertained by a simple inspection of the goods delivered, the User shall have the right to request that the goods delivered be replaced with goods conforming to his purchase request within 24 hours of notifying www.furnite.bg of such request by telephone at 359 (0) 888 817 472  or by email at hello@furnite.bg.

www.furnite.bg reserves the right to choose / change the subcontractor carrying out the delivery, without being obliged to inform the User in advance, as long as this does not affect the method and time of delivery.

www.furnite.bg carries out deliveries through subcontractor(s) only on the territory of Bulgaria.

8. Cancellation of purchased goods

The Consumer shall have the right to withdraw from the distance or off-premises contract without giving any reason, without compensation or penalty, within 14 days from the date on which the Consumer or a third party other than the carrier and designated by him took possession of the goods or the date on which the Consumer or a third party other than the carrier and designated by him took possession of the last goods, in the case of a contract under which you order multiple goods with one order.

In order to exercise his right of withdrawal, the User must notify www.furnite.bg of his name, geographical address and, if available, telephone number, fax number and e-mail address and of his decision to withdraw from the contract by an unequivocal statement (for example, a letter sent by post, fax or e-mail). The user can use the attached standard withdrawal form, but this is not mandatory:

The user may also complete and submit electronically the standard opt-out form or other unambiguous opt-out request at www.furnite.bg, and if the user uses this option, www.furnite.bg will promptly send a message in a durable medium (e.g., email) to confirm receipt of the opt-out. For the withdrawal period to be respected, it is sufficient for the consumer to send his/her communication concerning the exercise of the right of withdrawal before the expiry of the withdrawal period.

In the event that the consumer withdraws from the contract, www.furnite.bg will refund all payments received, excluding delivery costs , without undue delay and in any event no later than 14 days from the date on which the consumer informs www.furnite.bg of his decision to withdraw from the contract. www.furnite.bg will only make the refund to the customer's bank or card account.

www.furnite.bg has the right to postpone refunds until the goods have been received back or until proof has been provided that the goods have been sent back, whichever is the earlier.

The user must send to www. furnite.bg or return the goods without undue delay and in any case no later than 14 days after the day on which the user has informed www.furnite.bg of his withdrawal from the contract.

The deadline is deemed to have been met if the consumer sends the goods back to www.furnite.bg before the expiry of the 14-day period.

The consumer must bear the direct costs of returning the goods.

The consumer shall only be liable for any diminution in the value of the goods resulting from testing other than that necessary to establish their nature, characteristics and proper functioning.
The goods must be returned in their original packaging in their entirety, complete with accompanying documentation and without damage. www.furnite.bg reserves the right, in the event that the returned goods have damaged packaging, signs of use, scratches, knocks, shock damage, missing accessories, warranty card, to decide whether to accept the returned goods.

9. Warranty service

www.furnite.bg shall be liable for any lack of conformity of the consumer goods to the contract of sale which exists at the time of delivery of the goods and which manifests itself within two years after delivery, even if it had no knowledge of the lack of conformity.

A commercial guarantee is any obligation assumed by the trader or the manufacturer towards the consumer in addition to his obligation under this Act to ensure that the goods conform to the contract of sale, to refund the amount paid or to replace or repair the goods or to provide any other type of service relating to the goods where they do not conform to the specifications or, as the case may be, to other requirements unrelated to the conformity of the goods with the contract of sale, as set out in the application for a commercial guarantee or in the relevant advertising

With each delivery of goods subject to warranty service, www.furnite.bg shall issue and provide the User with a proper warranty card with the details of the goods and the warranty periods, as well as indicating all the terms of the commercial warranty provided, if any.

The User may not invoke and shall forfeit its rights under the Commercial Warranty provided:

(a) in case of a lost warranty card;

b) in the event of an attempt to carry out repairs and rectification of non-conformity by a person or service center not authorized bybbbshop.bg;

c) in case of damage caused by improper operation;

d) in case of damage to the physical integrity of the product;

e) in the event of chemical, electrical and/or other effects unrelated to the normal operation of the product;

The commercial warranty provided for the product does not cover product components with a limited shelf life (batteries, consumables, etc.). Warranty service shall be carried out only at the service centres indicated on the warranty card, provided that the product is fully documented and complete.

The products and services referred to on this Site are limited to the Terms and Conditions and information set out on the Site only, and no warranties of any kind are provided beyond those stated, including commercial and destination warranties. The obligations of www.furnite.bg with respect to the products and services offered on this Site are governed by the respective agreements with the importers and/or distributors of the products featured.

10. Other

www.furnite.bg has the right to unilaterally change any terms of delivery of the goods provided and any other information published on the Site without prior notice to the User.

www.furnite.bg reserves the right to send to the User messages related to new products and services, promotions and/or changes in the conditions and methods of delivery of the goods provided and any other information published on the Site www.furnite.bg administers this Site and its application is valid only for the territory of the Republic of Bulgaria. www.furnite.bg declares that the materials or services referred to in this Site are not appropriate or available outside the territory of the Republic of Bulgaria and, accordingly, access to them from territories outside the said territory is invalid.

Questions, inquiries and consultations of the User can be made op-line through the Site of furnite.bg on the form for questions and inquiries, or through an associate of the Department On-line at 359 (0) 888 817 472 , within the working hours: from 9:00 to 18:00, Monday to Friday.

These Terms and Conditions may be updated at any time, and their publication on the Site shall be deemed to notify users of the amendments. When using the Site at www.furnite.bg, Users are obliged to comply with these Terms and Conditions, as well as the applicable legislation of the Republic of Bulgaria, including international legislation, applicable to the goods and services provided on the Site.
